1. About BharatHaat

4. Marketplace Listings

Users may create listings subject to BharatHaat's rules and applicable law. All listing information must be accurate, complete, current, lawful, and non-misleading. Sellers are responsible for products, services, prices, descriptions, photographs, availability, quality, legality, and other information in their listings.

5. Prohibited Listings and Activities

Users must not use BharatHaat for unlawful, fraudulent, abusive, deceptive, or harmful activities.

6. Buyer and Seller Responsibility

BharatHaat primarily provides a platform for users to discover and connect. Unless expressly stated otherwise, BharatHaat is not the seller, manufacturer, owner, employer, landlord, broker, or service provider for third-party listings.

Users are responsible for independently verifying seller identity, product or service quality, ownership, price, availability, authenticity, documents, legal status, delivery arrangements, and payment terms.

7. Transactions Between Users

Transactions may occur directly between users or through payment or transaction services supported by BharatHaat. Unless expressly stated otherwise, BharatHaat does not guarantee that a seller will complete a transaction, a buyer will make payment, a product will match its description, a service will meet expectations, a listing will remain available, or a transaction will be completed successfully.

8. Fees and Memberships

BharatHaat may offer free and paid services, membership plans, promotional services, featured listings, advertising, or other commercial features. Applicable fees, plans, benefits, and conditions may be displayed before purchase. BharatHaat may change pricing or membership benefits from time to time, subject to applicable law and commitments already made to users.

9. Zero Commission

Where BharatHaat advertises a zero-commission marketplace model, this refers to the applicable marketplace commission policy and does not necessarily mean that every BharatHaat service is free. Other fees may apply to optional services, memberships, advertising, promotions, payment services, or other features.

10. Advertising and Promotions

BharatHaat may provide advertising, sponsored listings, promotional placements, business promotions, and other marketing services. Advertisers are responsible for ensuring that their advertisements are truthful, lawful, and do not infringe the rights of others.

11. Jobs, Property, Vehicles and Services

Listings relating to jobs, property, vehicles, and services may contain information supplied by third parties. BharatHaat does not guarantee the accuracy, legality, ownership, qualifications, employment conditions, property title, vehicle ownership, service quality, or other claims made by listing providers. Users should conduct appropriate verification before entering into any agreement.

12. Intellectual Property

The BharatHaat name, logo, website design, application design, software, text, graphics, trademarks, branding, and other original content are owned by or licensed to BharatHaat unless otherwise stated. Users may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit BharatHaat's intellectual property without prior written permission.

Users retain ownership of content they submit, but grant BharatHaat a non-exclusive, worldwide, royalty-free license to host, display, reproduce, process, and distribute that content as reasonably necessary to operate and promote the platform.

13. Content Moderation

BharatHaat may review, moderate, restrict, suspend, or remove listings, accounts, messages, advertisements, or other content where reasonably necessary to enforce these Terms, protect users, prevent fraud or abuse, maintain security, comply with law, or protect BharatHaat or third parties.

14. Account Suspension or Termination

BharatHaat may suspend, restrict, or terminate an account where there is a reasonable basis to believe that the user violated these Terms, engaged in fraud or abuse, provided false information, used the platform unlawfully, threatened platform security, or violated another person's rights.

15. Disclaimer

BharatHaat provides the platform on an "as available" basis. To the maximum extent permitted by applicable law, BharatHaat does not guarantee that the platform will always be uninterrupted, error-free, secure, or available. Information supplied by third-party users is their responsibility.

16. Limitation of Liability

To the maximum extent permitted by applicable law, BharatHaat will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from transactions or interactions between users. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by law, users agree to be responsible for claims, losses, liabilities, damages, and reasonable expenses arising from their violation of these Terms, unlawful use of BharatHaat, listings or content, transactions with other users, or infringement of another person's rights.

BharatHaat may update these Terms & Conditions from time to time. Updated Terms will be published on the website with a revised effective date.
